Having a baby is undoubtedly one of the most joyous occasions in a person’s life. With a child’s birth, there are some very important legal processes that must be followed. A process that some people forget is to register the child’s birth. What problems can this cause? Without a registration of birth it is impossible to get a birth certificate. The birth certificate is one of the most important documents anyone born in Canada can have.  If the child wants to travel, enrol in school, or qualify for a government program it is necessary to present a birth certificate.

What is the Delayed Registration of Birth? This is the process where someone who did not register their baby’s birth when they were born files an application to register the child’s birth. It is almost impossible to minimize the importance of registering a child. Without a registration, the child will not be given their Ontario birth certificate. Early in the child’s life, he can experience many problems since his parents did not fill out the registration of birth. Without a birth certificate, a child cannot register to attend school. Also, a birth certificate is needed if the child wants to qualify for government healthcare.  Secondly, without a registered statement of live birth –which also serves as the long-form birth certificate –it becomes very difficult for the parent to indeed prove that they are the parents of the child.

The process for a registration of birth, according to the Office of the Registrar General, takes about 16 weeks. In our experience, however, the time has ranged from 4 to 7 months. The process is exactly the same as a regular registration of birth only that this process will have two additional forms. Also, the mother will have to provide her birth certificate. If everything is done correctly, the Office of the Registrar General will send you a notice of registration. With the notice of registration it is then possible to get a birth certificate.

The process for a delayed registration of birth can only be expedited if there is an urgent matter. For example, if a child is over the age of 1 and will be leaving Canada permanently, expedition could be granted if valid proof is presented that the child will be leaving the country. Another possible reason that a delayed registration could be expedited is if there is proof that a child has a medical condition and needs to qualify for healthcare. Also, a delayed registration could be expedited if a child has to start attending school or other situations that the government may deem fit for an expedition.
